Terms of service
1.1 These terms and conditions apply to all sales of goods (Goods) by A. Royale & Co (Aust) Pty Ltd ACN 002 428 382 PO Box 5024, Chullora (Globite™) to you, the purchaser of the Goods.
1.2 These terms and conditions can only be waived in writing signed by an authorised officer of Globite™.
2.1 Your order for Goods (Order) must contain your correct name, invoice address, delivery address, telephone number, email address, credit card details and any other details Globite™ requires to process and deliver your order.
2.2 By placing your Order with Globite™, you offer to purchase Goods at the price specified in the Order.
2.3 Globite™ reserves the right to accept or reject any Order within 7 days of receiving the Order.
2.4 You must not order Goods for the purpose of re-selling or re-supplying them to third parties.
2.5 Globite™ may at any time cancel, vary or suspend all or some of the Orders you have placed without any liability to you:
(a) if you breach any of these terms and conditions in respect of an Order;
(b) Globite™ has insufficient stock to fulfil your Order; or
(c) Globite™ does not deliver to your nominated delivery address.
2.6 If Globite™ rejects an Order or cancels all or any part of an Order, you will be notified by email and Globite™ will refund any amount you have paid in advance for the Order.
3. Price and payment
3.1 The price payable for Goods is set out in this website and is in $AUD.
3.2 The price does include the Goods and Services Tax (GST) but not any postage, handling, freight, insurance, customs charges and other charges affecting the cost of the Goods. You will be told about these additional costs and be given a total purchase price before you finalise your Order.
3.3 You must pay the full price for the Goods you order at the time you place your Order. Payment must be made using the online ordering facility and via the methods Globite™ offers on this website. Orders that exceed your credit limit will not be processed.
4.1 Globite™ will deliver the Goods ordered to the delivery address provided when you placed your Order.
4.2 Any delivery times notified to you are estimates only and Globite™ is not liable for late or non-delivery.
4.3 Globite™ may, at your request, agree to postpone delivery of the Goods to a time more convenient to you provided that you agree to pay to Globite™ an additional amount in respect of such postponement and for storage charges.
4.4 Title and the risk of loss or damage to the Goods passes to you on delivery of the Goods to the delivery address.
5. Return of Goods
5.1 Globite™ does not give refunds on Goods just because you changed your mind or made a wrong decision or Subject to this clause, you may, if not satisfied with the Goods for any reason, return them to Globite™ within 30 days of the date of delivery of the Goods to you. This satisfaction guarantee does not apply to Goods damaged by abuse, improper or abnormal usage by you or a third party, or Goods damaged by a repair provided by a person not authorised by Globite™.
5.2 You must inspect the Goods on delivery and satisfy yourself that they are not damaged. If the Goods have been damaged before they were delivered to you, you must notify Globite™ within 48 hours of receiving delivery and must provide evidence of the damage, such as by way of photographs.
5.3 You must return the Goods in or with their original packaging, with all original accessories and contents and a copy of the relevant tax invoice, by registered post to Globite™ at PO Box 5024, Chullora NSW 2190 within 30 days of the date of delivery, to obtain a refund or, in the case of damaged Goods, replacement Goods. When you return the Goods you must send a letter stating your name, address, the purchase details and an explanation for the return.
5.4 Except where required by law or in accordance with this clause, Globite™ is not obliged to accept any return of Goods or pay the costs of their return. Globite™ reserves the right to refuse to accept any returned Goods marked “Cash or cheque on delivery” or “More to pay”. If Globite™ does not accept the return of the Goods, Globite™ will contact Customer in writing.
5.5 No refund will be payable to you until Globite™ has inspected the returned Goods and determined that the terms of this clause have been satisfied.
5.6 Nothing in this clause affects your rights under the Australian Consumer Law which may not be excluded or varied by agreement.
6. Limitation of liability
6.1 To the maximum extent permitted by law, all terms, guarantees, warranties, representations or conditions which are not expressly stated in this agreement or in a written warranty from Globite™ are excluded. If Globite™ is liable for breach of an imposed term, guarantee, warranty, representation or condition, Globite™’s liability is, at Globite™’s option, to the extent permitted by law, limited to:
(a) the replacement of the Goods or the supply of equivalent Goods;
(b) the repair of the Goods;
(c) the payment of the cost of replacing the Goods or acquiring equivalent Goods; or
(d) the payment of the cost of having the Goods repaired.
6.2 To the maximum extent permitted by law, Globite™ is not liable for any special, indirect or consequential loss or damage, loss of profit or opportunity and loss of data arising out of or in connection with the Goods, including as a result of not being able to use the Goods or the late or non-supply of Goods, whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise and whether or not Globite™ was aware that such loss or damage may occur.
7.1 This agreement will be governed by the laws of New South Wales and the parties submit to the non-exclusive jurisdiction of the courts of that state.
7.2 A notice given under this agreement must be in writing and sent to the recipient at the address specified below or such other address as notified from time to time.
7.3 If any clause or part of a clause is illegal, unenforceable or invalid, that clause or part is to be treated as removed from this agreement, but the rest of this agreement is not affected.
